If this is the case, I guess I've been battering my family for years.... This is just dumb, and any judge who doesn't throw this out with prejudice and is a jackass.
SOUTH CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.
Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.
Then, he failed sobriety tests and was arrested.
When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.
Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

Battery charge dropped....
CHARLESTON, W.Va. (Map, News) - A battery charge has been dropped against a West Virginia man who had been accused of passing gas and fanning it toward a South Charleston patrolman.
The Kanawha County prosecutor's office requested that the charge be dropped against 34-year-old Jose Cruz of Clarksburg. Mary Frampton, an assistant to Magistrate Jack Pauley, said Thursday the magistrate signed a motion to dismiss the charge.
A call to the prosecutor wasn't immediately returned.
Cruz, who was arrested Tuesday, still faces driving under the influence and other charges.
According to a criminal complaint, Cruz passed gas and made a fanning motion toward Patrolman T.E. Parsons after being taken the police station for a breathalyzer test. Cruz denies fanning the gas and says his request to use a restroom when first arriving at the station was denied.
